"Get giant immovable rocks outta my culvert story"...
Masked Man Armed with a bunch of papers in my hand, I was able to stand up to a real fast talker..basically a swindler and a crew of amateur construction guys. Previously our culvert, in a shared driveway washed away and the neighbor planted what I consider oversized boulders on top of the culvert. These giant rocks slid down into culvert in the next heavy rain and so to my eye the driveway and property stand to flood out because the bank of culvert getting crushed from colossal rocks that were on top of culvert
Those guy came back and Even though it was a turbulent encounter and not an easy thing to do I stuck my mask on, my jumpsuit and my hard hat! I had all my papers with me to show them and keep me on track when speaking to them and because of army corp of civil engineers telephone call and because of the sheriff's advice to me I was armed with information and with papers that made strong and eloquent when I had to stand up for what I think are my rights.
It was pretty cool because I was confident and educated when I I had to confront those guys and show them a plat and .tell neighbor and tell them all I had some say in the matter of this construction of the culvert. The neighbor lied about the county allowing him to do what he was doing. I did all the paperwork so I had to stick the paperwork in the guys face when he tried to ignore property lines and the army corp of civil engineers that he was supposed to contact before the previous work he did. I showed him pictures of the flood.
Neighbor turned his back on me with group but I kept pluggin away keeping it real saying I have some say in the matter..
Set that guy straight he got angry at which point I turned to the crew and asked if they wanted to see the plat at which they got into truck and left leaving poor neighbor all alone with eroding unpermitted culvert
Having the paperwork in hand really gave confidence in what I needed to do and say in the face of a fast talking bully.
I did this all in my safety mask
I had a letter from the sheriff in my hand I read outloud to them about getting a permit from the army corp before they tried to do any more unregulated work! The pen is mightier than sword,
That swindler was like "we will take care of it" then turning his back on me ..I had to say Hey don't you ignore me ..I have some say in the matter and I was real clear to them explaining how I was the only one that was there when the culvert flooded on the very spot they were all huddled on I told them about my theory about how we are going to have problems if the culvert becomes a dam...
It was like a movie I must admit when the neighbor threatened to throw into the creek in front of every body at which point I whipped out a photo of him from his own wife's facebook of him on our property encroaching with a CAT excavator from the previous time he got my property ... that's when I turned to the crew and told the foreman "Do you know what you re doing? You are working for a guy that wants to beat me up.". I then said they can call the sheriff if they want to see if they can remove me from my own property I stood there and whippied out a copy of the plat again and said you can listen to that guy if you want but it's only the written word that will hold up in a court of law " that's when they drove off leaving me alone with the swindler who also ran away from me at that point...
I guess I used a combination of street smarts from you and teenage years, legal paperwork, and some degree of conflict resolution right there. Nobody messes with the Masked Man! lol They fled.
I knew I had him when the guy refused to take my paperwork ..the whole crew abandoned him too because of the paperwork in my opinion .. Some people just refuse to read. Those guys that refuse to read always lose.
Now where it stands to me, my neighbor can get permit from the army corp of civil engineers and then contact me from there. I refuse to talk to a guy like that. Its kind of scary but I didn't really have a choice because I couldn't just let somebody on the property and doing things without permits like they are supposed to . At one point I asked sheriff and county what I should do and what is required of putting in culverts.. then I had to talk about all the details n the phone with army corp civil engineer..after having done all that I couldn't justlet a bunch of amateurs and a crooked neighbor redo the culvert again and just do whatever they wanted on my land over my head ..
I had to stand up and get tough but fair and I had to defend what I thought were my rights. so having done all the paperwork and knowing what was involved I offered them the paperwork and they ran like sheep!
I hesitate encouraging others to ever confront anyone person to person but .. I felt forced to handle it personally. I tried and tried to get the county and the army corp of civil engineers to handle for me ... ideally I never do anything person to person . It was surviving the flood that made it sensitive. I walked around in the hurricane Helene and made a video! lol made it impossible for me iso I put on my mask and construction helmet on when the crew came during sunny weather to dig up the creek after being in a hurricane and flood. Once you stand in the waters of destruction and survived a flood I just had to put those guys inline.
I guess was like having to fire somebody. I tried to be nice about it so while I prefer never to be in that position I I did the right thing.. They weren't there in the floodwaters so I just took over the operations being entitled to. The sheriff's letter in hand, the advice from county and army corp of civil engineers and photos of the flood empowered me and drove them away. Pretty wild. Its something I could never do without the pen and paper. It helps to be prepared with paperwork when you are masked and standing up for yourself.

Personally and for practical reasons I have my own theory and that is simply use small rocks and get the big immovable rocks out of there. Then every few years when a big flood comes simply let the culvert wash away and hope it does because then then the driveway won't flood as much and therefore both our home are safer. Cut your loses everytime this happens and rebuild the culvert same way and I as neighbor wouldn't sweat or make a stink about it.. I wouldn't call army corp on them.. but their mistake this time around was simply putting too much into their culvert by taking the giant rocks from creekbed make me think if they think the culvert might not wash away and actually the rocks might flood both our homes out because they impede the natural flow,...that's my beef. I told them that and while I think the crew understood I don't think my neighbor the fast talking swindler has the grey cells or understands physics enough so that's why I go to army corp of civil engineers to be on the safe side.
Don't reinforce a culvert so much it dams up and floods your own homes!

If you do have to have a person to person interaction wear a mask , Rehearse what you are going to say and do and behave before you go up to the maskless, Have paperwork in hand to give them. Have a back up plan as well to get outta there. I had a jumpsuit, mask, hard hat and boots at the door waiting for me and all the paperwork at the door as well as antibiotic soap ready before I approached anybody I knew what I was going to say and what I wasn't going to say...and when I returned I immediately washed my hands and sprayed the papers I held in their faces and threw my clothes in washer first before removing my mask .. I clean my glasses too and jumped in shower after that.
I ran those guy off and they ran off because they knew they were wrong! I stayed as safe as possible wearing a mask and taking all precautions and I still defended my home and my rights.
That guy was a jerk threatened to throw this Masked Man in the creek in front of construction crew but then the whole crew abandoned him when I said here are the papers read 'em and weep I said the the written word will hold up in court. I told them they were on all on my land and they could call the sheriff if they wanted! That's when they left me alone with the guy who threatened to throw me in the creek and he cowered away once his crew left him and took off in his truck too! ha! Ha!
