Irresponsible Hen And Rooster Owners Beware!

SUMMARY:
The Masked Man lives next to Irresponsible Hen And Rooster Owners. It's a big deal to me. I take measures to prevent and reduce the chances of avian flu on my property so this is forcing me to call local 'animal care & control' again.

I don't think people realize how seriously I take this transgression. It is truly neglectful to allow hens and roosters to stray. I don't approve of hens and roosters straying onto my property and consider it highly dangerous.  This has routinely happened to me before and I am calling upon animal control for help with this issue. I take all precautions such as masking and other precautions when shooing them  away from my property.

I will keep this forum posted on developments as I remedy this problem.

P.S. It is disrespectful to routinely let hens and roosters stray onto other people's property and it is dangerous as well because of bird flu. I am very angry and with good reason as this is very disruptful to me , my loved ones, and other creatures and it is not fair to the roosters or chickens either to let them stray. I'm going to fix this problem I am contacting a third party such as local animal care and control first while considering contacting other third parties such as local law enforcement in mind as well and I will keep readers posted.

now I'm gonna go and shoot that area of dirt the chickens clawed and  kicked up with their tail feathers with some light Clorox spray .. I might as well because I have three beautiful wild feral cats that live under our back porch that we feed. It will probably be okay because the chickens weren't too close to our house but I might as well spray that area just incase to clean that area because of the outdoor cats that are like outdoor pets to us.

This has occurred in the passed.. always wear masks and also were goggles... these animals flap and just to give you a sense of how dangerous they can be one flapped very close to back of my neck.. I totally understand why these creatures transmit bird flu after being so close to them...also rooster get weird and aggressive around their hens and have razor sharp claws... they are very unhygienic and shed and flap like crazy I can't imagine entering a coop and not being afraid of disease here's me shooing them away from property... (farmers have to be stupid for not masking and wearing goggles in my experience) Here's me shooing rooster with hens off property from last year or two ago:

As usual, Its taking my local animal care and control some time to reply back if they do at all so here is my latest request to them to try to goad them to actually get off their own tail feathers and do something:

"Dear Animal Control

Hi,
I’m having issues with stray Chickens and roosters straying into my yard at *** *** rd and onto your other neighbor’s property  as well at*** *** rd from the owners of ****** road again. Here’s a current video.

It’s really a hassle for me because I have to put on my mask and gloves and shoo this livestock off my property and I’m not really experienced with poultry. Perhaps you could talk to the neighbors at *** *** ** rd for me about their livestock straying. I am extremely sensitive to this. I take care of an elderly 79 year old and we want to be left alone by people and livestock entering our backyard. I take all precautions against covid and bird flu and wear a mask so I prefer my privacy.

"Dear Animal care and control,
 I can easily catch these creatures in my trap cage  if need be.
I prefer not to  because this is time consuming and would prefer animal care and control's assistance. What are the typical procedures or protocols that I should adhere to and would I be within the confines of the law were I to trap a rooster that is possibly being neglected by its owners or is in harm's way on my property?

I simply can't have stray but domesticated  roosters this many days in a row on my property because they are in harm's way and a hazard to me in my opinion... I feel obligated to capture and protect these roosters and hens from other animals such as cats and my own dog as well.
So do you recommend I set my cage tomorrow ..I am studying how to trap them from here because I have a similar trap cage:

.. is this  legal and humane  for me to trap these roosters and hens according to watauga county ordinances and if so where do I bring the first rooster ?

P.S. Ive had problems with animal control before to be honest I had major problems with animal control not fining my neighbors or getting after them for letting a big white German shepherd mix stray in my yard all the time...

...so if animal control doesn't take this issue of stray roosters in my yard or bird flu seriously enough to do something...I'm  for sticking that rooster, trap and all in the back of a  bicycle trailer and pedaling in my mask all the way to the county building and letting that rooster out of the cage in their county administrative building if they don't do something about it and if they think I'm joking!

Let them take care of the rooster if they don't think it is anything for me to be concerned about or for the public not to be concerned about it.. let the county administrative building take care of the rooster without a mask if they aren't threatened by a stray nasty red rooster with razor sharp claws!

(I am very concerned about avian flu and Let’s hope animal care and control will step up to the plate and help me… I am only kidding about letting loose a rooster in a county building although I must admit it is a mighty tempting considering how frustrating this is for me a masked person to deal with someone else’s livestock… I’ll try to get this problem solved through proper channels hopefully)

YES! I got some cooperation I didn't expect and I got a response from my local animal care and control:

Animal Control writes:
"We've spoken with the chicken owners and have advised them to keep their animals up. You can send pictures and videos if they return, and they will be deemed Public Nuisance if they are out again".

Masked Man replies:
"Thank you for your work! It means a lot to us. I hadn't had any problems with their roosters and hens for a fairly long stretch of time until the last several recent days . Hopefully your talk helped them out. I guess they moved some hutches around or something so hopefully they can contain their livestock responsibly now".

...So this good news in that I got a third party such as animal control to help make my neighbor's more responsible for their livestock which in turn makes it safer for my feral cats and my yard when it comes to attempting to prevent unnecessary bird flu and help prevent animal interactions amongst domesticated livestock and animals in the wild and in my backyard.

The footage you see is of my yard that keeps getting invaded by chickens. I finally got sick of waiting for animal control to do anything so I caught two chickens and neighbor drove by to get his chickens back ... I'm sick of these people allowing chickens to roam free onto my land.. here the guy near truck argues and lies to me pretending that the chickens weren't in my yard but were in the other neighbor's yard... it was in my yard and the chickens shouldn't be in my other neighbor's yard either.
These people who let their chickens stray on my land are mad at me because I keep calling animal control and today the guy told me to shoo his chickens from my land by throwing a rock at the chickens to shoo them away..
...I have no intention of hurling a rock at chickens in my yard. Not on video is I stuck the cage of chickens up to the cab of the owners truck and tried to get the chickens into the guys truck but the guy grabbed my cage and we stuck his chickens in the back of his truck. I warned the guy not to bend my cage.. these particular chicken owners are morons. All I want to do is walk my dog on his leash in my own back yard without my dog sniffing or eating chicken poo from a flock of chickens.

Masked Man has to stand up for himself! :) I can't have my dog Scamp sniffing and lickng chicken poo on his little walk in my own backyard now can I!?...lolI caught his chickens and  like a good neighbor I returned them back to my neighbors.. I don't see what that chicken owner in the truck is so angry for.. what's his problem what's the attitude is all about .He should be grateful. ..lol what's up with people!? People get all mad when I return their stray pets to them. They should give me a reward! lol

I love this.. this how I deal with stress, conflict, grievances... I produce stuff ... I make art out of living and create films ... that last movie is about as stressful as it gets for me. Instead of getting angry and shooting the chickens I shoot them with a camera on film and while I try to avoid personal encounters sometimes one just has to face people... gotta stand up for myself. Chickens in my yard all the time so I I'll just catch the chickens. So I talked to the  and the The guy ended up being somewhat nice to me but he wants me to tend to his chickens and I don't buy that because he wants me to throw a rock at the chickens to shoo his chickens out of my yard . I'm not about to throw a rock at his chickens! you know that would get me in trouble with his wife who is apparently watching me in my yard...lol next thing they would do is call animal control on me. I kid you not the guy picked up a rock and hurled it at his own chicken while it was in my yard and I was showing him the boundaries...lol I am uncomfortable with that so I'' just keep making videos ..lol.. At one point he acted like he was going to call the police..I retorted" go ahead and call a lawyer while you're at it!" I called his bluff ... its ridiculous. Then I told the guy I liked him and we actually touched elbows instead of shaking hands but I have no intention of babysitting his livestock and will continue to send video after video of chickens in my yard to animal control! lol
After all that I sprayed everything and I threw my clothes in laundry before taking off mask.. washed hands over and over and then  showered .. chickens are nasty.Always wear mask and goggles two when handling livestock. How dare anybody force their animals upon me , upon others  and how dare anybody force their animals upon other animals such as my little dog when its leashed and in its own yard eh?

The great thing about the mask is not only am I protected from airborne diseases, also nobody sees the goofy smile on my face and I don't have to be embarrassed by my fat puffy gut as seen in the above video during bow shooting scene featured in video Link above.

My letter to the friendly sheriff about my day dealing with animal control trying to explain to the world I don't want roosters an hens in my yard because of bird flu and because I just don't want chicken poo in my yard and I have a dog...

"Now I gotta share with you my crazy day

For months I have written about animal care and control about my problems with chickens... They come and poo all over my yard and I then I have to walk my dog and the dog sniffs and wants to eat the poo.. I can't have that so I keep videos and compile the recent incidents I date everything and show the chickens and roosters(roosters are aggressive around henns and I do have concerns over avian flu NC the U.S. Department of Agriculture, or USDA: Egg farmers in North Carolina (the state I reside in) alone lost 3.3 million birds to the bird flu in January. North Carolina is among nine states with bird flu outbreaks confirmed in January and February 2025 by the federal Animal and Plant Health Inspection Service
... I send my grievance to animal control listing dates as thus(I'll spare you the videos );

At this point I couldn't take it anymore and trapped two chickens on my own property then returned to owner in attempts to send message to owner I prefer these chickens to be with him and then I produced a video of my day on the 18th The owner says his wife was watching me and the chickens from distance and then the owner consoled me to throw rocks at the birds whenever they enter my property to shoo them away(I have no intention of throwing rocks or tending their chickens)

..and attached is a plat of the land we own across the river bend ... the chickens walk up the right away and enter our porch as well and crap all over the yard where I want to take my dog for daily walks without eating their chicken poo

Then  I add if  you can’t wear a safety mask for some reason for Diana your officers may still inspect the property area  in question to inspect and we will stand at bay. And I may assist periodically.

So they show up and start asking me where exactly the boundary line is. (I'm thinking Chickens don't care where the boundary lines are!) But anyway, it's like they are arguing with me and then (neighbor who I don't like) J**dy E**er comes out and starts taking over and gets in my face or rather my mask pointing out to boundary lines ...I tell him this isn't about you, J**dy, it's about chickens in my yard....  The animal control officer starts giving me tips on how to best video tape these creatures... Meanwhile J**dy E**er is yelling while walking around .... The owner of chickens enters pictures... Then J**dy makes his way through my yard near Diana who is masked on her back porch from some distance and I run in between J**dy and tell him to get off my property as he approaches Diana without a mask because he wants to talk to her face to mask.. I holler three times to get off my property and on the fourth time I say "you either put on a mask or get off my property!! Finally he turns around to join animal control ...Diana goes back into the house to write to the sheriff.
I go back outside and tell the chicken owner that is standing there amongst animal control "I like you as a neighbor, I like chickens, I wish I could have chickens myself, But we can't have chickens in our yard because I have a dog and I am sorry. She nods and replies I met her husband.. I reply "your husband seems nice (I did met her husband and explain I can't have chickens in my yard and it was civil)
Then J**dy started running around blabbing interrupting I say to animal control" I have to diffuse this situation and I have to leave now (because J**dy E**er is 'going off' and butting in and interrupting all discourse... animal control says she will email me... I go back into house and throw clothes in washer, take off mask and wash myself

Then I email animal control
"I thought it best to diffuse the situation so I had to leave the meeting prematurely.  I felt like I was being interrupted and Diana's welfare might be in jeopardy due to Mr. E**er approaching her on my property. I feel  the focus of why you were here was being  interrupted by alleged land disputes from Mr. J**dy E**er. I assure my sole interest is in the welfare of chickens. Currently my loved on is speaking with law enforcement about Mr. E**er. I felt the presence of Mr. E**er was interrupting your work so I look forward to hearing from you at another time" .

"So I think the owners of the chickens understand but man that was nuts! lol  I'm telling you man people have it in for me... what a morning. I have a bad feeling J**dy E**er is going to try to come after me because he knows he doesn't have permit from us army corp of civil engineers for culvert(s) he put in after hurricane Helene washed them out and nearly flooded us ... I'm gonna stay in my home and never come out brother and just play guitar. People are crazy right now.. I don't envy your job, Sheriff.

"Oh yeah I gotta share some more:
after I sent animal control videos of 7 days worth of chicken videos that occurred on my land according to plat

Wat***a county Animal care and control replied:


"Good morning. We have reviewed all video footage, Property lines based on the document you've sent us, spoken to witnesses (the chicken owner, the neighbors) and we have been out in person to view property lines.


The chickens have not once been documented on your property.

That area around the shed belongs to the *** Jo***n * C***k RD.

The neighbors agreed they have no problem with the chickens coming to their land.

The animals are cared for. They are wanted. They have housing, water, and food.

They have shown no sign of disease nor aggression.

The signage you have is not authorized for the area you are in and is void.


In conclusion there is no violation and nothing to enforce."


...  so I Masked Man replied:
" I politely disagree as I have plat and I disagree

Roosters are renowned for aggression and dominance around their hens according to zoologists and animal husbandry people... Roosters are extremely dangerous around their hens. Also I said these birds are easy target for predetators out in the open and are also prone to disease. Also the owner indicated to me he had a missing rooster that he said a dog probably got. I am thinking what kind of loving owner would allow his pets to freely roam after he just lost a rooster? Also a missing rooster means the animal control officer is wrong about the animals being well cared for and safe. Also the owner told me to throw a rock at the chickens if they came onto my property(I have no intention of throwing rocks at chickens)!"

...after that animal control set up the meeting for today which J**dy E**er butted in and totally interrupted whatever BS animal control was going to tell me.

These animal control people know nothing about roosters and chickens! Its crazy and totally unfair to the beautiful rooster and chickens ! lol

Anyway thanks for letting me share.

Like I said, maybe the chicken owners learned something today and they will take better care of their chickens after hearing me yell at J**dy E**er to get off my property..lol..

Sheriff, I bet you have tons of crazy stories and encounters...

NC General Statute 68-25 prohibits allowing fowls to run at large after three days' notice. If an owner continues to allow their fowls to run at large after receiving the notice, a magistrate may order them to be killed by a sheriff or other officer. This is a Class 3 misdemeanor, and fines may be assessed.
Here's a more detailed explanation:

    Notice Requirement:
    If a person is found to be in violation of the law by allowing fowls to run at large, they are given a three-day notice to confine the fowls.

    Persistent Violation:
    If the owner fails to confine their fowls within the three-day period, a magistrate may order the fowls to be killed.

Let's try to control animal control and play with their minds a little after having revealed that I could just go to the magistrate and get the sheriff or an animal control officer to go over that and shoot the chickens , fine the owners and charge them with a #3 misdemeanor according to NC State Statutes  ...

Masked Man will share with you what he sent animal care and control in light of the state statutes...


"Dear animal care and control,
I don't  want the chickens killed. But I do think the owners have a right to be warned and  informed of this statute and that you might be forced to shoot their beautiful birds if they can't keep them contained.

I however do not plan on exercising my state rights. I like chickens. Nevertheless I can't have these chickens in my yard and if it keeps happening it is an option that I have the right to pursue. I have been more than patient and fair to all parties concerned.

maybe I shouldn’t advise you to warn the owners of the statutes.. I don’t know.. . that being said use your own professional judgement. We are dealing with creatures and humans … i resent being in this position. I trust your judgement as to what you think should be communicated. I like chickens and I like people. This is a state law at my disposal but calling upon this statute makes me uncomfortable personally. We both are self governing so feel free tell me what you think is best way to proceed with this. Personally between you and me this sucks. I like people , I like chickens , but I can’t have chickens around me.. it’s horrible . Tell me what you think I should do or what you plan to do.. if I may share with you  I do not like any of this and it hurts to have we to make any decisions as to state statutes. I’m open to any of your ideas . Nothing has to happen immediately. You tell me what you think should happen next.

I used to be a security guard for a poultry plant  in Virginia called Rocco.  It was not a great job. Mostly I was alone as semi truck after semi truck transported turkeys . There at that worksite after dark  I had to deal with domestic disputes in the parking lot a lot at night. Couldn't even speak the language of the people fighting... had to walk through a giant concrete area sourounded by nothing but implements of death for the scores of chickens and turkeys they slaughtered all day. I have since retired from that job. After all that I just can't be around chickens anymore.  I hope I'm not acting too insensitive about chickens in my yard but I think people should know why I am sensitive about being around  poultry. It makes me kind of ill.The smell of the chickens and the feces makes me feel like I'm back at Rocco.

I have respect for the lives of the chickens but I have more respect for me and Diana and I have to protect us. I'm not happy with the way animal control has treated me. They don't wear masks for Diana.. They don't take avian flu as seriously as me. They definitely don't care about the birds and they don't care about me or Diana. They just don't respect our lives... and the animal control people are ignorant of the state laws.. so I think that's why I have to pursue the state statutes or laws... I don't think its right to let or encourage roosters and hens run at large   like animal control does.. I simply agree with the state statutes that  fowls shouldn't be allowed to run at large because I think its dangerous and leads to all sorts of conflicts which is probably why it is a state statute.
